Reasonableness

By accessing and using this website, as well as all websites operated by Self Enquiry Life Fellowship (which includes hansavedas.org, hansavedas.academy, sambhala.hansavedas.org and publications.hansavedas.org) (collectively the “Site”) you agree that the exclusions and limitations of liability set out in this website disclaimer are reasonable. If you do not think they are reasonable, we advise you not to access or use the Site.

You agree that the Site itself, as well as all content, videos, training materials, services and/or other materials, made available on the Site (collectively referred to as the “Content”) are maintained for your personal use and information by Self Enquiry Life Fellowship (the “Nonprofit”) and are the property of the Nonprofit and/or its third-party providers. You agree that such Nonprofit Content shall include all videos, HTML/CSS, JavaScript, graphics, voice, and sound recordings, artwork, photos, documents, and text as well as all other materials included in the Site. Subject to your compliance with these Terms of Use, the Company hereby grants you a limited license, which is non-exclusive, non-transferable, and non-sublicensable, to access, view, and use the Site solely for your personal purposes. No Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, used for public or commercial purposes, or downloaded in any way unless written permission is expressly granted by the Nonprofit. Modification of the Content or use of the Content for any other purpose is a violation of the copyright and other proprietary rights of the Nonprofit, as well as other authors who created the materials, and may be subject to monetary damages and penalties. You may not distribute, modify, transmit or use the content of the Site or any Content for public or commercial purposes without the express written permission of the Nonprofit.

All Content, such as text, data, graphics files, videos and sound files, and other materials contained in the Site, are copyrighted unless otherwise noted and are the property of the Nonprofit.

The use of Content by you is strictly prohibited unless specifically permitted by these Terms of Use. Any unauthorized use of Content may violate the copyright, trademark, and other proprietary rights of the Nonprofit and/or third parties, as well as the laws of privacy and publicity, and other regulations and statutes. Nothing contained in these Terms of Use or in the Site shall be construed as granting, by implication or otherwise, any license or right to use any Trademark or other proprietary information without the express written consent of the Nonprofit or third party owner.

No warranties

The materials in this Site are provided without warranties of any kind either expressed or implied. To the fullest extent permissible pursuant to applicable law, Self Enquiry Life Fellowship disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of merchant-ability and fitness for a particular purpose. The Nonprofit does not warrant that the functions contained in the materials will be uninterrupted or error-free, that defects will be corrected, or that this Site, including bulletin boards, or the server that makes it available, are free of viruses or other harmful components. The Nonprofit does not warrant or make any representations regarding the use or the results of the use of the materials in this site or in third-party sites in terms of their correctness, accuracy, timeliness, reliability or otherwise. You (and not Self Enquiry Life Fellowship) assume the entire cost of all necessary maintenance, repair or correction.

The Nonprofit does not warrant that this Site will be constantly available, or available at all.

Limitations of liability related to losses

Self Enquiry Life Fellowship will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this Site:

- to the extent that the website is provided free-of-charge, for any direct loss
- for any indirect, special or consequential loss, or
- for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.

These limitations of liability apply even if Self Enquiry Life Fellowship has been expressly advised of the potential loss.

Limitations of liability related to practices

By voluntarily participating in any Self Enquiry Life Fellowship class, training, workshop, retreat, online material, other service, or by accessing and using the Site, you agree to the acknowledgements below:

You agree, on behalf of yourself and your heirs and legal representatives, to hereby waive, release and discharge any and all claims, actions, and suits for damages for personal injury, death or property damage which you may incur, against the Nonprofit, its affiliates and their respective employees, officers, directors, agents and volunteers as a result of your use of the Site or any services that the Nonprofit may provide via the Site, or practice/application of the techniques learnt. This release is intended to discharge the Nonprofit, its affiliates, and their respective employees, officers, directors, agents and volunteers and any public agencies from and against any and all liability arising out of or connected in any way with your use of the Site or practice/application of the techniques learnt.

There may be risks and dangers involved in the practices of meditation, pranayama (breathing exercises), mantra chanting, and yoga exercises. Some pranayama (breathing exercises) may cause altered states of awareness and fainting. Some practices may require physical exertion which may be strenuous and may cause aggravated physical injury, and you are fully aware of and willingly assume the risk and hazards involved.

It is your sole responsibility to consult with a physician prior to practicing any of the techniques taught online via the Nonprofit’s Site, or at any of the classes, programs, retreats, workshops, online materials, and events held by the Nonprofit. You represent and warrant that you are physically fit and have no medical condition which would prevent your full participation in these activities. You understand that accidents and injuries can arise out of your participation in certain practices which may be taught on the Site; knowing the risks, you hereby agree to assume those risks and to release and to hold harmless all of the persons or agencies mentioned above who might otherwise be liable to you (or your heirs or assigns) for any loss or damages. It is the intention of the parties hereto that the provision of this paragraph be interpreted to impose on each party responsibility for their own negligence.

Medical Disclaimer

The coursework and the Site offers higher-yoga related meditation, wellness, fitness and nutritional information and is designed for education purposes only. You should not rely on this information as a substitute for, nor does it replace, professional medical advice, diagnosis, or treatment. If you have any concerns or questions about your health, you should always consult with a physician or other health-care professional. Do not disregard, avoid or delay obtaining medical or health related advice from your health-care professional because of something you may have read on this site or practiced from the coursework. The use of any information provided on the Site and the in-person coursework teaching is solely at your own risk.

Nothing stated in the coursework or posted on the Site or available through any services are intended to be, and must not be taken to be, the practice of medical or counseling care. For purposes of this agreement or waiver, the practice of medicine and counseling includes, without limitation, psychiatry, psychology, psychotherapy, or providing health care treatment, instructions, diagnosis, prognosis or advice.

Recipe and Elixir Disclaimer

Recipes for food and elixirs shared on the Site have not been evaluated by the FDA. They are not intended to diagnose, treat, cure or prevent any disease. Your use of our recipes is subject to these Terms of Use, our Privacy Policy and Medical Disclaimer.

All content shared or provided is strictly for informational purposes only. While all attempts have been made to verify the accuracy of information provided on our website and within the publications, neither the authors nor the Nonprofit are responsible for assuming liability for possible inaccuracies.

The authors and Nonprofit disclaim any responsibility for the inaccuracy of the content, including but not limited to errors or omissions. Loss of property, injury to self or others, and even death could occur as a direct or indirect consequence of the use and application of any content found herein.

Exceptions

Nothing in this website disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this website disclaimer will exclude or limit Self Enquiry Life Fellowship liability in respect of any:

- death or personal injury caused by the negligence of the Nonprofit
- fraud or fraudulent misrepresentation on the part of the Nonprofit
- matter which it would be illegal or unlawful for the Nonprofit to exclude or limit, or to attempt or purport to exclude or limit, its liability.

Other parties

You accept that, as a limited liability entity, Self Enquiry Life Fellowship has an interest in limiting the personal liability of its officers and employees. You agree that you will not bring any claim personally against Self Enquiry Life Fellowship officers or employees in respect of any losses you suffer in connection with the Site.

Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set out in this website disclaimer will protect the Nonprofit officers, employees, agents, subsidiaries, successors, assigns and sub-contractors as well as the Nonprofit.

In case of infringements of your copyright

The aim of Self Enquiry Life Fellowship is to use original or royalty-free material throughout the website wherever possible. However, if you believe that we have copied your work on the Site in any way that constitutes an infringement of copyright, please contact us with information to back up your claim such as a description of the copyrighted work that you claim has been infringed and where the material is located on our website.

Jurisdiction

These terms shall be governed by and interpreted in accordance with the laws of California without regard to its conflicts of laws provisions. You agree to the personal jurisdiction by and venue in the state and federal courts of Santa Barbara County, California, and waive any objection to such jurisdiction or venue.
